On 24 April 1973 (the day before CJI Sikri retired), the Supreme Court delivered 11 separate opinions totaling 703 pages. By a razor-thin 7–6 majority, the court ruled: **Parliament has wide power to amend the Constitution, but it CANNOT alter its Basic Structure.** Swami Kesavananda Bharati lost his land petition, but his name became immortalized as the case that saved Indian democracy.
During the 1975 Emergency, the government passed the 39th Amendment to make Prime Minister election unchallengeable in any court. The Supreme Court used the Basic Structure Doctrine to strike it down, declaring Judicial Review and Free Elections part of the untouchable Basic Structure. Today, India’s democracy stands protected because no government can ever rewrite the foundational pillars of the republic.
