Rinku Rukshar v. State of U.P. and 4 Others

In August 2020, petitioner Rinku Rukshar approached the Allahabad High Court via a writ of habeas corpus seeking the production and restoration of her minor son, Asif, aged under six years. Married in 2014 under Muslim rites, she alleged repeated domestic cruelty and claimed she was assaulted and forcefully thrown out of her matrimonial home while her husband, Arshad, fled with their tender-aged child.

The respondent husband Arshad raised a formidable preliminary objection: under Muslim Personal Law, the father is the natural legal guardian, and no writ of habeas corpus can lie against a natural parent. He contended that the mother must be relegated to standard civil litigation before the Family Court under the Guardians and Wards Act, 1890.†

The bench examined Section 352 of Mulla's Principles of Mahomedan Law, which unequivocally establishes that a mother is entitled to the custody (hizanat) of her male child until he has completed the age of seven years. Depriving the mother of custody of a toddler without lawful judicial sanction rendered the father's detention unlawful in the eyes of equity.

The Allahabad High Court directed the State authorities to produce the minor child before the bench. Upon visual examination and inquiry, the Court verified the tender age of minor Asif and recorded that the child had been abruptly removed from maternal care amidst acute matrimonial friction.†

In oral arguments, counsel for the father cited Supreme Court precedents holding that custody with a father is not per se illegal. Counsel for the mother countered with leading Apex Court judgments (Gohar Begum, Tejaswini Gaud), asserting that child welfare is the paramount consideration and supersedes dry technical statutory claims.

The Allahabad High Court analyzed the synthesis between statutory guardianship laws and constitutional equity. The Court observed that while the father is the legal guardian, his physical detention of a child under seven years against the mother's hizanat is unlawful without Family Court approval.¶8

The ruling reinforced a critical doctrine in Indian matrimonial and constitutional law: personal law rights of biological parents are always subordinate to the paramount welfare of the infant child. It reaffirmed that constitutional courts will not permit procedural technicalities to deny mothers the care and custody of young infants.¶14
